These Terms & Conditions ("Terms") govern your access to and use of SubTracks (the "Service"), operated by Mohammed Moshii ("SubTracks", "we", "us", "our"). By creating an account, accessing, or using the Service you agree to be bound by these Terms.
1. The Service
SubTracks is a subscription-tracking application that helps users discover, monitor, and forecast their recurring charges, including AI-tool subscriptions, by parsing receipts from connected email inboxes.
2. Acceptance & Authority
You confirm you are of legal age in your jurisdiction and have authority to enter into these Terms, either personally or on behalf of any organization you represent.
3. Account & Credentials
You must provide accurate information and keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
4. Acceptable Use
You must not misuse the Service. In particular you must not:
- use the Service for unlawful, fraudulent, or deceptive purposes;
- send spam or unsolicited communications;
- infringe the intellectual property or privacy rights of others;
- introduce malware, attempt to probe, scan, or breach security; or
- scrape, reverse engineer, or attempt to circumvent technical limits.
5. Intellectual Property
SubTracks and Mohammed Moshii retain all right, title, and interest in and to the Service, including all software, documentation, designs, and branding. You receive a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan.
6. Payments, Subscriptions & Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations, and refunds are governed by the Paddle Buyer Terms in addition to these Terms. Subscriptions automatically renew until cancelled.
7. Service Level & Warranties
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.
9. Suspension & Termination
We may suspend or terminate your access to the Service at any time for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the Service immediately ceases.
10. AI-Generated Content
The Service may use AI to classify receipts and provide insights. Outputs may be inaccurate or incomplete and should not be relied on as financial, legal, or tax advice. You are responsible for verifying outputs before acting on them.
11. Changes
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the seller's jurisdiction. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer law provides otherwise.
